Soon after the Municipal Corporation of Delhi (MCD) asked dog parents to get their pets registered or pay a fine given the rising cases of dog bites, the activists said imposing fines without providing facilities is illegal.
The rising cases of dog bites have resulted in clashes between dog parents and resident welfare associations (RWAs) or apartment owners’ associations (AoAs). Many dog parents complained of harassment and the authorities issued notices to AoAs for allegedly harassing dog parents and issuing illegal fines.
Delhi civic body has issued a warning to dog parents asking them to get their pets registered, failing which they will be penalized. On the other hand, opposing the action, the activists said that fining without providing any facilities is illegal.
“The municipality cannot impose any kind of fine or demand any fee without providing facilities for the dog parents. No fee can be charged without providing facilities like a dog park in each ward, a poop dumpster in the dog park, free anti-rabies vaccination for pet dogs. Without such facilities, demanding any fine or fee is against the law,” said Abhivan Srihan, renowned animal rescuer and founder of Fauna Police.
“The authorities imposing fines must be held liable for not providing such facilities. There shall be a two-way common interest for betterment of society and to create balance between dog parents or dog lovers and residents. One cannot keep targeting dog parents or feeders without providing them any facility,” said Srihan.
Similarly, Kaveri Rana Bhardwaj, animal rescuer and founder of SMART dog sanctuary said, “The authorities are not allowed to slap any kind of fee or fine until they provide a solution to the problems. If the authority asks a dog parent to pick the poop of their dogs, where will it go if there is no poop dumpster in the locality. If there is no designated dog poop area, where will the dog parents take them? Before deciding to demand a fee or issue a fine, the authorities will have to take care of such problems.”
